General Terms and Conditions (GTC)
1. Scope
1.1 These General Terms and Conditions (GTC) apply to all orders placed via the online shop Las Almas Institute Baleares SL (hereinafter "Provider" or "we") on the website www.lasalmasgroup.com (hereinafter “Webshop” or “Shop”).
1.2 These Terms and Conditions apply exclusively to the business relationship between the Provider and the Customer. Any deviating or conflicting terms and conditions of the Customer will not be recognized unless the Provider has received express written consent.
2. Contracting party
2.1 The purchase contract is concluded with Las Almas Institute Baleares SL, based in Avinguda Joan Miró 17 /1G, 07014 Palma de Mallorca, Spain, registered in the Mercantile Register of [city, province], under number [number].
2.2 The contract shall be concluded in Spanish.
3. Products and services
3.1 The Provider sells medical devices, performance devices and related products (hereinafter "Products").
3.2 All products on the website are to be understood as "non-binding offers." No guarantee is given regarding the availability of the products. The provider reserves the right to change the product range without prior notice.
3.3 Products expressly labeled "for professional use only" may only be used by trained professionals. The customer is responsible for ensuring that the products are used in accordance with legal regulations and instructions.
4. Conclusion of contract
4.1 The presentation of the products in the online shop does not constitute a legally binding offer, but merely an invitation to the customer to submit an offer.
4.2 The customer makes a binding offer by completing the order process in the shop.
4.3 The Provider will send the Customer an order confirmation by email confirming receipt of the offer. A purchase contract is only concluded when the Provider accepts the Customer's order, which usually occurs by shipping the goods.
5. Prices and shipping costs
5.1 All prices quoted are final prices and include VAT (IVA) at the current rate [Percentage, e.g. 21%], unless otherwise stated.
5.2 Shipping costs are added to the prices indicated and will be displayed during the ordering process.
5.3 The provider reserves the right to change the prices of the products at any time, however the prices stated at the time of the order shall apply.
6. Delivery
6.1 The products will be delivered to the address indicated by the customer in Spain and other EU countries.
6.2 Delivery is usually within 10 Working days after receipt of the order.
6.3 The provider is not liable for delays caused by third parties (e.g. shipping companies) or unforeseeable events (force majeure).
7. Payment
7.1 Payment is made using the payment methods specified in the ordering process, such as credit card, PayPal, bank transfer or other options offered.
7.2 The provider reserves the right to change or restrict payment methods without giving reasons.
8. Right of withdrawal
8.1 Customers have the right to cancel the contract within 14 days after receipt of the goods without giving reasons.
8.2 The revocation must be declared in writing (e.g. by email or post).
8.3 The goods must be returned to the provider within 14 days of cancellation at your own expense and risk.
8.4 Excluded from the right of withdrawal are products that are not suitable for return for health or hygiene reasons, as well as products that have been adapted to the customer's needs after delivery.
9. Defects and liability
9.1 The Provider assumes legal liability for defects in the Products existing at the time of delivery, in accordance with the current provisions of the Spanish Civil Code.
9.2 The customer is obliged to check the goods for defects upon receipt and to notify the provider of any defects immediately.
9.3 The provider's liability for damages caused by slight negligence is excluded, except in the case of injury to life, body or health.
10. Guarantee
10.1 The provider grants a statutory guarantee of 2 years from the delivery date.
10.2 The customer has the right to have defective products repaired or replaced free of charge within the warranty period, provided that the defect was not caused by improper use or external influences.
11. Data protection
11.1 The provider collects, processes and uses the customer’s personal data in accordance with the applicable data protection regulations, in particular the General Data Protection Regulation (GDPR).
11.2 Further information on data protection can be found in the privacy policy of the provider, which is available on the website.
12. Retention of title
12.1 The goods remain the property of the provider until the purchase price has been paid in full.
12.2 The customer is obliged to handle the goods with care until full payment has been made.
13. Applicable law and place of jurisdiction
13.1 The law of the Kingdom of Spain shall apply.
13.2 Any disputes arising from this Agreement shall be subject to the jurisdiction of the court having jurisdiction over the registered office of the Provider.
14. Final provisions
14.1 Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
14.2 Amendments and additions to the contract must be made in writing.
Terms and Conditions Las Almas Institute
1. Scope
These Terms and Conditions apply to all patients who use the services of the Las Almas Clinic in Mallorca. They govern the contractual relationship between the clinic and the patient. By registering and being admitted to the clinic, the patient agrees to these Terms and Conditions.
2. Services of the clinic
The clinic offers specialized treatments for psychosomatic illnesses and addiction disorders, provided by qualified professionals. The exact details of the treatment and available programs are explained during the individual admission interview.
3. Conclusion of contract
The contract between the clinic and the patient is concluded once the patient has paid the deposit of 40% of the cost estimate and received confirmation of registration. The contractual agreement is binding once the deposit has been received.
4. Patient's duties
The patient undertakes to participate in the prescribed treatment programs and follow the instructions of the treating staff. Should the patient repeatedly and without good reason violate these obligations, the clinic reserves the right to terminate the contract and discharge the patient early.
5. Costs and payment terms
The costs of treatment are explained clearly and transparently before admission. Payments are generally due at the start of treatment or according to the agreed payment plan. The clinic accepts various payment methods, which are determined in advance. In case of non-payment, the clinic may take legal action.
6. Cancellation fees
Up to 30 days before the start of treatment, 70% of the deposit will be refunded. Between 29 days and 7 days before the start of treatment, 30% of the deposit will be refunded. From 7 days before the start of treatment, the deposit will be retained.
7. Liability
The clinic is only liable for damages resulting from the intentional or grossly negligent conduct of its employees. The clinic assumes no liability for damages resulting from the patient's conduct or unforeseeable events.
9. Data protection
The clinic undertakes to treat all patient personal and health data confidentially in accordance with applicable data protection regulations. Data will only be shared with third parties if necessary to carry out treatment or if the patient expressly consents.
10. Changes to the Terms and Conditions
The clinic reserves the right to change these terms and conditions at any time. Changes will be communicated to patients in a timely manner and will be deemed accepted if the patient continues to use the clinic.
11. Place of jurisdiction and applicable law
All disputes arising from this contractual relationship shall be governed by Spanish law. The place of jurisdiction shall be the clinic's registered office.
